Information on data collection pursuant to Art. 13 and 14 of the General Data Protection Reguation of the European Union (GDPR)

This information is given for the purpose of transparency about how limoss GmbH & Co. KG handles personal data. The protection of personal data enjoys a very high priority, therefore the processing of personal data takes place in accordance with the legal regulations, in particular with the regulations of the General Data Protection Regulation of the European Union (GDPR) and the Code of Social Law.

3. Processing purposes

Your personal data includes information such as your name, address, telephone number or e-mail address. Personal data will only be collected, processed and / or used if you provide us with it voluntarily, e.g. for the establishment, content or modification of a contractual relationship concluded between you and us, or registration for personalised services, or if you send us an enquiry via the website. In addition, your personal data will only be used if you have given your prior consent. After completion of the respective contract, your data will be restricted for further processing and deleted after expiry of any labour, tax or commercial retention periods, unless you have expressly consented to the further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this declaration.

4. Legal principles and purposes of processing

a) On the basis of your consent (Art. 6 (1) (a) GDPR)

If you have given your consent to the processing of personal data for certain purposes, this processing is deemed to be lawful on the basis of your consent. Consent that has been given can be revoked at any time. This also applies to the revocation of declarations of consent that you gave us before the GDPR (General Data Protection Regulation) came into force, i.e. before 25th May 2018.

Please note that revocation is only effective for the future. Processing that took place before the revocation is not affected by this.

b) To fulfil contractual obligations (Art. 6 (1) (b) GDPR)

The processing of personal data (Art. 4 (2) GDPR) is carried out to provide our services, in particular to execute our contracts or pre-contractual measures with you and for the execution of your orders as well as for the purposes of customer administration and support and the conclusion, execution and termination of an employment contract concluded with you.

c) Based on legal requirements (Art. 6 (1) (c) GDPR) or in the public interest (Art. 6 (1) (e) GDPR)

Your personal data may be processed by us on the basis of other legal obligations, e.g. court orders.

d) As part of the evaluation of interests (Art. 6 (1) (f) GDPR)

If necessary, we process your data beyond the actual fulfilment of the contract to protect the legitimate interests of us or third parties. For example, for:

  • Better customer service
  • Ensuring IT security and IT operation, e.g. transmission protocols
  • With suppliers: Consultation of credit agencies (to determine creditworthiness and default risks)
  • Examination and optimisation of procedures for requirements analysis and direct customer contact
  • Advertising or market and opinion research, provided that you have not objected to the use of your data for these purposes
  • Assertion of legal claims and defence in legal disputes
  • Measures for business management and further development of services and products

5. Data transfer

Personal data may be disclosed to public bodies that receive data pursuant to statutory provisions (e.g. social insurance institutions, fiscal authorities, supervisory authorities, health insurance funds, employment agencies, integration offices, health authorities) as well as banks and contract data processors within the meaning of Art. 28 GDPR.

6. Duration of data storage

If your personal data is no longer required for the above-mentioned purposes, it will be deleted regularly, unless its - temporary - storage is still necessary for the fulfilment of contractual or legal obligations. Reasons for this can be, for example:

  • Obtaining evidence for legal disputes under the statutory limitation periods: Civil limitation periods can be up to 30 years, with a regular limitation period of three years
  • Log data is stored for up to 2 years and your enquiries to our customer service for up to 3 years
  • After expiration of these periods, the data will be deleted after a post-processing period

7. Your rights

You have the following rights, which you may exercise at any time free of charge vis-à-vis limoss GmbH & Co. KG.

Right to information: You have the right at any time to request confirmation as to whether, and how, personal data concerning you will be processed and to receive the data made available to us in a structured, common and machine-readable format.

Right to rectification: You have the right to ask us to correct any incorrect or incomplete personal data concerning you.

Right to deletion: You have the right to demand the deletion of your data if the conditions specified in Art. 17 GDPR are met. Afterwards you can, for example, request the deletion of your data insofar as this is no longer necessary for the purposes for which it was collected. You can also request deletion if we process your data on the basis of your consent and you revoke this consent.

Right to restriction of processing: You have the right to demand the restriction of processing if the conditions set out in Art. 18 GDPR are met.

Right to objection: You have the right to object to the processing of your personal data at any time for reasons relating to your particular situation, provided that such processing is carried out as part of an evaluation of interests or in the public interest.

Right to complain: As a data subject, you have the right to complain to the supervisory authority if you are of the opinion that the processing of your data violates data protection regulations. The right of appeal may, in particular, be exercised before a supervisory authority in the member state in which the person concerned is staying or working or in which the alleged infringement occurred.

8. SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or requests that you send to us as the site operator. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

9. Data collection on our website

Cookies

This data is collected on the basis of Art. (6) (1) GDPR. The website operator has a legitimate interest in technically error-free presentation and optimisation of the operator’s website - for this purpose, it is necessary to record the server log files.

10. Analysis tools and advertising

Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google Analytics uses so-called "cookies". These are text files which are stored on your computer and which permit an analysis of your use of the website. The information generated by the cookie about your use of this website will generally be transmitted to, and stored by, Google on servers in the United States.

Google Analytics cookies are stored on the basis of Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in analysing user behaviour in order to optimise both the operator’s website and advertising.

IP anonymisation

We have activated the IP anonymisation function on this website. As a result, your IP address will be truncated by Google within member states of the European Union or other signatory states to the agreement on the European Economic Area prior to transmission to the United States. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics is not combined with other data from Google.
